Would statutory rape charges be pursued in California for oral sex?
I dont think it matters if they are over 18 or not, Californias age of consent is 18. If the person engaging in sex with a minor is less than 3 years older or younger than the minor, then they are guilty of a misdemeanor. So basically, if two 17 year olds have sex, they are both raping each other. But the point is, it is a minor offense the closer in age they are to one another. I would think a therapist reporting such a thing would be very irresponsible. And I think it is very unlikely anyone would pursue it, unless there were other things going on (like it was non-consensual in other senses).
